As a condition of your enrollment in the Soul Magic Healing program (the “Program”) presented by Walk Into Possibility, LLC, (called “Walk” ) and Janna Zarchin, the enrolled participant agrees to the following terms and conditions (the “Terms and Conditions”): Please initial each paragraph on the line provided and sign both pages.
As between You, any person or entity claiming through You, and Walk. You acknowledge that Walk owns all right, title and interest (including without limitation, all rights of copyright and trademark) in and to any recorded, written and/or graphic materials (whether in printed, digital, electronic or other form) which are delivered to You or to which You have access in connection with the Program. You agree that You will not copy, reproduce, distribute, sell or exhibit the Materials without the prior written consent of Walk. You acknowledge that Walk will suffer irreparable harm in the event that You violate the provisions of this paragraph 1 and, therefore, Walk may obtain injunctive relief to prevent any actual or threatened breach by you of this paragraph.
You acknowledge that Walk may collect or record information relating to Your participation in the Program, including video recordings of You, audio recordings of Your voice, and written testimonials or writings sent to Walk and Janna Zarchin. You further acknowledge that Janna Zarchin promotes her future programs, in part, by distributing video and audio recordings, and testimonials of its past programs. You hereby irrevocably give Walk and Janna Zarchin permission to use and distribute recordings of Your likeness and voice, and to use Your name and any written testimonials or emails sent by You to Walk and Janna Zarchin to promote its future programs and to otherwise commercially use recordings containing the same in all media and formats now known or hereinafter devised in perpetuity throughout the world without any additional consideration to You.
Walk, Janna Zarchin and her agents disclaim any and all warranties (including without limitation, any warranty of merchantability, and/or warranty of fitness for a particular purpose) regarding the Program or the results You may achieve from participating in the Program. The testimonials and examples used in the Program are exceptional results, do not apply to every participant, and are not intended to represent or guarantee that You will achieve the same or similar results. As with any business endeavor, there is an inherent risk of loss and there is no guarantee that You will increase Your wealth or receive any other benefit as a result of participating in the Program.
During the Program, You may participate in exercises involving self-examination and You may experience emotional or physical reactions. You acknowledge that although the program leader may be a licensed mental health professional, you hereby acknowledge the coaching program does not constitute a therapy session and no therapist/patient relationship is established by participation in this program. You assume all risks relating to Your participation in the Program and You hereby release Walk and Janna Zarchin from all claims and liabilities based on any harm or loss You suffer as a result of Your participation in the Program, even if caused by the negligence of Walk and Janna Zarchin.
Should You decide to not participate in the Program after enrolling, Walk and Janna Zarchin will issue a refund of the purchase price actually paid by You provided that You email Your request for a refund by midnight of the third business day after signing up for the Program to Janna@JannaZarchin.com. You acknowledge that Walk and Janna Zarchin offers NO refunds whether for cancellations or other reasons after the above noted deadline. Do not register for this program if you have any concerns about the above refund policy or your ability to participate in the Program.
If You purchase the Program using installment payments and for any reason fail to make any payment in full when due, You no longer have the right to any course materials and Walk and Janna Zarchin will not refund any prior payments. If You choose to cancel Your participation in the Program for any reason, You will lose all access to the Program and the Materials at that time, AND if You elect to cancel and then choose to re-join, You are not guaranteed a spot back in the group.
You understand that any problem of a medical or psychological nature may be treated legally only by medical doctors or other health practitioners.
You understand that you are personally responsible for your well-being and life choices, regardless of what information is received during the program. The Program is intended to provide insight on a spiritual level for making life improvements and are not intended to replace therapy or medical treatment or your own personal sense of what is right or wrong.
Walk and Janna Zarchin neither accepts or assumes any responsibility whatsoever for your personal choices or actions. Any referral you may receive to another person, product or company is done without endorsement or warranty. You understand that due to individual differences in commitment and participation, results that you may achieve from Walk and Janna Zarchin’s services may differ from the results achieved by others and Walk and Janna Zarchin may not make any EXPRESS or IMPLIED warranties of any type or nature whatsoever with respect to such services.
RELEASE OF LIABILITY
You hereby (on my behalf and on behalf of my spouse, domestic partner and children, if any, together with my heirs, personal representatives, successors and assigns) for and in consideration of the opportunity to register and participate in the Program and for other good and valuable consideration, the receipt and sufficiency of which you hereby acknowledge, absolutely and unconditionally release and hold harmless Walk and Janna Zarchin, and her affiliates, officers, directors, shareholders, employees, contractors, coaches, staff and agents (hereinafter the “Released Parties”) from and against any and all claims, liabilities, damages, demands, suits, rights and causes of action of any kind or nature whatsoever whether arising in tort or contract which you or anyone claiming through me, now has or later may have against the Released Parties in any way resulting in whole or in part from, arising out of, or in connection with the Program and my participation in the Program.
The forgoing release extends to any and all claims you have or later may have against the Released Parties resulting from or arising out of the Program whether or not the claims result from negligent, reckless or willful conduct on the part of any or all of the Released Parties with respect to Program or with respect to the conditions, instructions, rules or procedures under which the Program is conducted or from any other cause. YOU UNDERSTAND THIS MEANS YOU AGREE NOT TO SUE ANY OR ALL OF THE RELEASED PARTIES FOR ANY INJURY RESULTING TO YOUSELF OR YOUR PROPERTY ARISING FROM OR IN CONNECTION WITH YOUR PARTICIPATION IN THE PROGRAM.
WAIVER OF RIGHTS UNDER STATE STATUTES
These Terms and Conditions shall be governed by the laws of the State of New York. Any legal action or proceeding arising under the Terms and Conditions may be initiated only in the state and federal courts located in the state of New York. You irrevocably consent to the jurisdiction of such courts and agree that venue will be proper in any such court.
Under no circumstances will Walk and Janna Zarchin be liable to You or any other person for any damages arising from Your agreement to these Terms and Conditions, enrollment and/or participation in the Program (whether actual, exemplary, punitive, consequential, special, incidental, direct or indirect damages) which exceed the amount actually paid by You to participate in the Program.
You hereby acknowledge that you have read and voluntarily accept these Terms and Conditions and further agree that no oral representations, statements or inducements have been made to You in connection therewith. These Terms and Conditions and accompanying Acknowledgement and Release Agreement constitute the full and entire understanding and agreement between You and Walk and Janna Zarchin. These Terms and Conditions may only be amended or modified by a written instrument executed by both You and Walk and Janna Zarchin.
THIS IS A LEGAL DOCUMENT WITH LEGAL CONSEQUENCES. BY AGREEING TO THESE TERMS AND CONDITIONS, YOU ARE GIVING UP RIGHTS YOU MAY OTHERWISE HAVE.
